07/99 - The Town and Country Planning (Development Plans and Consultation) (Departures) Directions 1999

This circular and its annexes reproduce the Town and Country Planning (Development Plans and Consultation) (Departures) Directions 1999 and provide policy guidance on them.

The directions require that certain planning applications which do not accord with the provisions of the development plan, and which the local planning authority do not propose to refuse, should be notified to the Secretary of State.

The local planning authorities are advised to only notify significant departures, and the Secretary of State will normally only call in for his own determination those applications which raise issues of more than local importance.

A decision making sequence is proposed to help local planning authorities to reach their conclusions on the matter, and criteria on which to judge the significance of a development proposal are listed.
