The information in paragraph 88, that an applicant's failure to respond to a direction under regulation 4 of the Applications Regulations 1988 does not invalidate the application, has been withdrawn with the issuing of the Best Practice Guidance on the Validation of Planning Applications.

 

This circular was issued as an accompaniment to the Town and Country Planning (General Permitted Development) Order 1995 and the Town and Country Planning (General Development Procedure) Order 1995.

The main changes in the Permitted Development Order were that development requiring environmental assessment will not attract permitted development rights, and the rights attached to dwelling houses in conservation areas were restricted.

Permitted development rights were extended to the demolition of gates, walls etc in a conservation area, with Article 4(2) directions being available to withdraw certain rights. Main changes in the Procedure Order included new consultation arrangements; for example, planning authorities were for the first time required to consult English Heritage and the Garden History Society over applications likely to affect certain grades of park or garden.

Appendices cover, among other matters, best practice in handling planning applications, consultations before the grant of permission, and Article 4 directions. The guidance on telecommunications development has been superseded by that in PPG8.
