A Guide to Determinations and Appeals - Updated Addendum June 2005

Following Machinery of Government changes in May 2002, the Office of the Deputy Prime Minister (ODPM) took on responsibility for Determinations and Appeals from the former DTLR. The following changes to contact details in the Guide should therefore be noted:

All other references in the Guide to "the Secretary of State for Transport, Local Government and the Regions" and the "Department for Transport, Local Government and the Regions / DTLR" should also now read "the First Secretary of State" and the "Office of the Deputy Prime Minister / ODPM" respectively.


FURTHER ADDITION

PARAGRAPH 34, ADD NEW SECOND AND THIRD SENTENCES:

"The local authority is required to make a decision within a period of two months from the date of your application, but can extend this period if you agree. If the local authority does not notify you of their decision within this timescale, you will be entitled to appeal to the Secretary of State/NAW as if the authority had refused your application (see paragraphs 35 & 36)."
