28/92 - planning and compensation act 1991: modification and discharge of planning obligations

This circular and its annexes describe certain of the provisions in section 12 of the Planning and Compensation Act 1991 which was brought into effect on 9 November 1992.

The provisions are new sections 106A and 106B of the Town and Country Planning Act 1990, which were inserted by section 12 (1) of the 1991 Act. Annex A describes the new procedures relevant to modifying and discharging planning obligations. Annex B sets out the Town and Country Planning (Modification and Discharge of Planning Obligations) Regulations 1992 (S. I. 1992/2382).
