Appeal Time Limits

Householder planning application

12 weeks from the date on the decision notice.

However, if an enforcement notice has been served for the same or very similar development the time limit is:

  • 28 days from the date of the LPA decision if the enforcement notice was served before the decision was made yet not longer than 2 years before the application was made.
  • 28 days from the date the enforcement notice was served if served on or after the date the decision was made (unless this extends the appeal period beyond 12 weeks).

NB – if the LPA have failed to determine your householder planning application or you are appealing against the grant of permission subject to conditions to which you object, please follow the time limits under “Planning application” below.

Planning application

6 months from the date on the decision notice, or

6 months from the expiry of the period which the LPA had to determine the application.

However, if an enforcement notice has been served for the same or very similar development within the previous 2 years, the time limit is:

  • 28 days from the date of the LPA decision if the enforcement notice was served before the decision was made yet not longer than 2 years before the application was made.
  • 28 days from the date the enforcement notice was served if served on or after the date the decision was made (unless this extends the appeal period beyond 6 months).

NB – the LPA determination period is usually 8 weeks (13 weeks for major developments and 28 days for non-material amendment applications). If you have agreed a longer period with the LPA, the time limit runs from that date.

Listed building consent or conservation area consent application

Within 6 months of receipt of the decision, or

Within 6 months of the expiry of the period which the LPA had to determine the application.

NB – the LPA determination period is usually 8 weeks. If you have agreed a longer period with the LPA, the time limit runs from that date.

Advertisement consent

Within 8 weeks of the date you receive the decision, or

Within 8 weeks of the expiry of the period which the LPA had to determine the application.

NB – the LPA determination period is usually 8 weeks. If you have agreed a longer period with the LPA, the time limit runs from that date.

Advertisement discontinuance notice

Before the effective date of the notice (the effective date will be shown on the notice).

Enforcement notice

Before the effective date of the notice (the effective date will be shown on the notice).

Listed building enforcement notice

Before the effective date of the notice (the effective date will be shown on the notice).

Conservation area enforcement notice

Before the effective date of the notice (the effective date will be shown on the notice).

Certificate of lawful use or development

No time limit.

NB – the LPA determination period is usually 8 weeks, although you may agree a longer period with the LPA.  An appeal on the grounds of non-determination can only be made following the expiry of the determination period.

Community Infrastructure Levy appeals

Chargeable amount appeals (Regulation 114)

Before the end of the period of 60 days beginning with the day on which the liability notice stating the original chargeable amount was issued.

Apportionment of liability appeals (Regulation 115)

Before the end of the period of 28 days beginning with the day on which the demand notice stating the amount payable was issued

Charitable relief appeals (Regulation 116) 

Before the end of the period of 28 days beginning with the date of the decision of the collecting authority on the claim for charitable relief.

Surcharge appeals (Regulation 117)

Before the end of the period of 28 days beginning with the day on which the surcharge is imposed.

Deemed commencement appeals (Regulation 118) 

Before the end of the period of 28 days beginning with the day on which the demand notice is issued.

CIL stop notice appeals (Regulation 119)

Before the end of the period of 60 days beginning with the day on which the CIL stop notice takes effect.
