Commenting on Commons Applications

If you wish to comment on an application regarding common land or a town or village green, please write to the address below quoting the name of the common or green concerned. Letters and e-mails should reach us before the date mentioned in the notice published in the local press.

When determining applications for consent for works (under Section 38), or deregistration of common land (under Section 16), The Inspectorate will take the following into account:

  • The interests of persons having rights in relation to, or occupying, the land (and in particular persons exercising rights of common over it);
  • The interests of the neighbourhood;
  • The public interest, including nature conservation, the conservation of the landscape, the protection of public rights of access to any area of land and the protection of archaeological remains and features of historic interest;
  • Any other matters considered to be relevant.

We will also have regard to the policy guidance published by Defra in relation to consents issued under the Commons Act 2006. This guidance can be found on the Defra website.
