Rights of Way

Rights of way are minor public highways that exist for the benefit of the community at large, in much the same way as the public road network does. They are the most widely recognised opportunity for the public to enjoy the English countryside.

The Planning Inspectorate deals with opposed Orders which are seeking to either:-

  • create, divert or extinguish rights of way
  • modify the definitive map and statement for an area

We also deal with unopposed orders which require modification in some way.

Checklist for Order Making Authorities

When an Order Making Authority submits an order to the Secretary of State for determination, they also need to provide a number of supporting documents. Without these accompanying documents we may not be able to proceed.
