DoE 18/94 and WO 76/94 (23 November 1994)
This circular offers guidance on the provisions in sections 77 to 80 of the Criminal Justice and Public Order Act 1994 which affect gypsies and unauthorised campers.
It explains that section 77 of the Act empowers local authorities to direct vehicle dwellers to leave certain sites - namely those where people are residing unlawfully in vehicles on highway land, other unoccupied land or occupied land where they do not have the consent of the occupier.
It describes the policy of tolerance of unauthorised occupation where no unmanageable nuisance is occurring. The Act repeals the duty of local authorities to provide and manage sites as required by the Caravan Sites Act 1968.
