SI 2012 3109 - The Town and Country Planning (Development Management Procedure) (England) (Amendment No. 3) Order 2012

The Town and Country Planning (Development Management Procedure) (England) (Amendment No. 3) Order 2012 (“the Order”) amends the Town and Country Planning (Development Management Procedure) (England) Order 2010 (2010/ 2184) (“the Development Management Procedure Order”) to reduce the nationally-prescribed information requirements for outline planning applications and provide that local information requirements are only applicable to planning applications if they were published less than 2 years
before the application in question was submitted.

 

SI 2012 3046 - The Regional Strategy for the East of England (Revocation) Order 2012

This Order revokes the Regional Strategy for the East of England and all directions preserving saved county Structure Plan policies within the region. It completes the process to remove the regional planning tier in the East of England region, which was commenced by the Localism Act 2011.

 

SI 2012 2920 - The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012

These Regulations consolidate, with amendments, the Town and Country Planning (Fees for Applications and Deemed Applications) Regulations 1989 (S.I. 1989/193) (“the 1989 Regulations”) and instruments which have amended those Regulations, in relation to England. The principal amendments include raising existing fees in line with inflation and introducing two new fees. Fees were last increased in 2008 and the proposed increase addresses the current shortfall created by inflation.

 

SI 2012 2274 - The Town and Country Planning (Development Management Procedure) (England) (Amendment No. 2) Order 2012

The Town and Country Planning (Development Management Procedure) (England) (Amendment No. 2) Order 2012 (“the Order”) amends the Town and Country Planning  (Development Management Procedure) (England) Order 2010 (“the DMPO”) to change the rule relating to applications for grant of a replacement planning permission. The Order also introduces an additional requirement into the DMPO in relation to local planning authorities’ decision notices. The Planning (Listed Buildings and Conservation Areas)(Amendment) (England) Regulations 2012 (“the Regulations”) amends the Planning (Listed Buildings and Conservation Areas) Regulations 1990 (“the 1990 Regulations”) to change the rule relating to applications for consents to works where an associated application for grant of a replacement planning permission is made.

 

SI 2012 2552 - The Housing and Regeneration Act 2008 (Consequential Provisions) Order 2012

The purpose of the Housing and Regeneration Act 2008 (Consequential Provisions) Order 2012 is to amend secondary legislation in consequence of the changes brought in by Part 1 of the Housing and Regeneration Act 1998, which abolishes the Commission for the New Towns and establishes the Homes and Communities Agency.

 

2012 801 - The Town and Country Planning (Development Management Procedure) (Wales) Order 2012
This Order provides for procedures connected with planning applications, consultations in relation to planning applications, the determination of planning applications, appeals, local development orders, certificates of lawful use or development, the maintenance of registers of planning applications and related matters.

 

SI 2012 793 (W.108) - The Planning (Listed Buildings and conservation Areas) (Wales) Regulations 2012

These Regulations consolidate with amendments the Planning (Listed Buildings and Conservation Areas) Regulations 1990 (“the principal Regulations”) and subsequent amending instruments, in so far as they apply to Wales.

 

SI 2012 767 - The Town and Country Planning (Local Planning) (England) Regulations 2012

The Regulations (a) consolidate the existing Town and Country Planning (Local Development) (England) Regulations 2004 and the amendments made to them; and (b) make new provision and amendments to take account of the changes made by the Localism Act 2011.

 

SI 2012 749 - The Town and Country Planning (Compensation) (England) Regulations 2012

Permitted development
2.1 The Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2012 amends the Town and Country Planning (General Permitted Development) Order 1995 (“GPDO”) by:

  • adding a new Part 43 to Schedule 2 to introduce permitted development rights for solar panels, ground and water source heat pumps, and flues forming part of biomass and combined heat and power systems installed on non-domestic premises.
  • inserting new paragraphs into Parts 6 and 7 of Schedule 2 to clarify that permitted development rights can apply under those Parts to structures to house biomass boilers, anaerobic digestion systems and associated waste and fuel stores, and hydro turbines installed on agricultural and forestry units, and
  • amending paragraph J of Part 40 of Schedule 2 (interpretation of Part 40) to delete the words “product and installation” from the definition of “MCS Planning Standards”.

Compensation
2.2 The Town and Country Planning (Compensation) (England) Regulations 2012
replace the Town and Country Planning (Compensation) (England) Regulations 2011 (the “2011 Regulations”), and in doing so insert one additional description of prescribed development under paragraphs (2A)(a) and (3C)(a) of section 108 of the Town and Country Planning Act 1990. The additional description of prescribed development is:

  • development permitted by Part 43 of Schedule 2 (installation of nondomestic
    microgeneration equipment).

The transitional provision relates to Part 40 which was amended in December.

 

SI 2012 637 - The Neighbourhood Planning (General) Regulations 2012

The Regulations set out the procedure for the designation of neighbourhood areas and neighbourhood forums and for the preparation of neighbourhood development plans and neighbourhood development orders (including community right to build orders). A separate instrument will be brought forward in relation to neighbourhood planning referendums.

 

SI 2012 636 - The Town and Country Planning (Development Management Procedure) (England) (Amendment) Order 2012

This Order amends the Town and Country Planning (Development Management Procedure) (England) Order 2010 (“DMPO”) in relation to statutory consultees and to the keeping of registers by local planning authorities, in England.

 

SI 2012 605 - The Town and Country Planning (Tree Preservation) (England) Regulations 2012

Local planning authorities protect trees in the interests of amenity by making Tree Preservation Orders (TPOs). Provisions are spread across primary and various  secondary legislation and different rules apply depending on when the TPO is made.

The Government is keen to simplify the TPO system. This reflects the Government’s ambition to cut through red tape that adds costs and puts unnecessary burdens on individuals, business and local government. Using powers in section 192 of the Planning Act 2008, these regulations put a simpler, fairer unified system in place for all existing and future TPOs in England.

 

SI 2011 2056 - The Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2011

The order amends the Town and Country Planning (General Permitted Development) Order 1995 (“GPDO”) by:

- inserting new Classes D and E into Part 2 of Schedule 2 to introduce permitted development rights for electric vehicle charging points in offstreet public and private car parking areas

- substituting a new Class A into Part 12 of Schedule 2 to clarify that local authorities can install on-street electric vehicle charging points as
permitted development

- substituting a new Part 40 to Schedule 2. Making minor amendments to the existing permitted development rights for the installation of specified
microgeneration equipment on or within the curtilage of dwellinghouses and blocks of flats and granting planning permission for the installation of additional types of microgeneration equipment on or within the curtilage of dwellinghouses and blocks of flats subject to certain criteria.


SI 2011 1824 - The Town and Country Planning (Environmental Impact Assessment) Regulations 2011

These Regulations replace the Town and Country Planning (Environmental Impact assessment (England and Wales) Regulations 1999 (SI No. 293) (“the 1999 regulations”) and subsequent amending instruments. The Town and Country Planning (Environmental impact Assessment) (Mineral Permissions and Amendment) (England) Regulations 2008 remain in force. These Regulations, except for the provisions relating to projects serving national defence purposes, extend to England only. The 1999 Regulations remain in force for Wales.

 

SI 2010 2184 - The Town and Country Planning (Development Management Procedure) (England) Order 2010

This Order consolidates the Town and Country Planning (General Development Procedure) Order 1995 (S.I.1995/419) and instruments which have amended that Order, in relation to England. This Order also makes amendments to the provisions as to applications to replace an extant planning permission. The Regulations make corresponding amendments to the Planning (Listed Buildings and Conservations Areas) Regulations 1990 (S.I. 1990/1519) ("the Listed Buildings Regulations").

 

SI 2010 2135 - The Town and Country Planning (Compensation) (No.3) (England) Regulations 2010

The Town and Country Planning (General Permitted Development) (Amendment) England) (No. 2) Order 2010 amends the Town and Country Planning (General Permitted Development) Order 1995 to:

-  give permitted development rights for buildings used as dwellinghouses, to use as small scale houses in multiple occupation shared by three to six people without the need for a specific planning application

-  make a minor amendment to correct a reference in the procedure for making a direction to remove permitted development rights.

 

SI 2010 948 - The Community Infrastructure Levy Regulations 2010

These Regulations provide for the imposition of a charge to be known as the Community Infrastructure Levy which is to be levied on the grant of planning permission for development.

 

SI 2010 601 – The Town and Country Planning (Regional Strategy) (England) Regulations 2010

The Regulations cover detailed requirements relating to the revision of regional strategies by the responsible regional authorities under Part 5 of the Local Democracy, Economic Development and Construction Act 2009 (“the Act”). The Order amends secondary legislation

 

SI 2010 567 - The Town and Country Planning (General Development Procedure) (Amendment) (England) Order 2010

This order amended the provisions of the Town and Country Planning (General Development Procedure) Order 1995 (S.I. 1995/419) as to design and access statements, and the publicity of planning applications; to amend the time limits for lodging certain planning appeals; and to include on the planning register applications for non-material changes to permissions.

 

SI 2010 472 - The Town and Country Planning (Fees for Applications and Deemed Applications) (Amendment) (England) Regulations 2010

These Regulations amend, as to England only, the Town and Country Planning (Fees for Applications and Deemed Applications) Regulations 1989 (“the 1989 Regulations”). The amendments provide for fees to be payable for the determination of applications to the local planning authority for a new planning permission to replace an existing permission for development that has not yet commenced and for a non-material change to an existing planning permission.

 

SI 2010 305 - The Infrastructure Planning (Decisions) Regulations 2010

These regulations prescribe a list of matters to which the relevant decision-maker (either the Infrastructure Planning Commission or the Secretary of State) must have regard when taking decisions on applications for nationally significant infrastructure projects.

 

SI 2009 453 - The Town and Country Planning (General Development Procedure) (Amendment) (England) Order 2009

This document amends the current Town and Country Planning (General Development Procedure) Order 1995. The amendments introduce a reduced time limit and different documentary requirements for household appeals and make a minor change to the definition of ‘playing pitch’ for the purposes of consultation requirements under Article 10 of the GDPO.

 

SI 2009 452 - The Town and Country Planning (Appeals) (Written Representations Procedure) (England) Regulations 2009

These regulations deal with the appeal procedure for written representations. They revoke and replace, with some changes, the Town and Country Planning (Appeals) (Written Representations Procedure) (England) Regulations 2000, subject to the transitional and saving provisions in regulation 20.

The main changes made are the introduction of a new, faster procedure for household appeals dealt with on the basis of written representation.

 

SI 2009 401 - The Town and Country Planning (Local Development) (England) (Amendment) Regulations 2009

These regulations amend the Town and Country Planning (Local Development) (England) Regulations 2004, which make conditions relating to local development planning.

Amongst the significant changes, they add the Homes and Communities Agency as a statutory consultee when preparing development plan documents, and remove the requirement for LPAs to consult the Secretary of State for Transport when preparing a Statement of Community Involvement.

 

SI 2008 2362 - The Town and Country Planning (General Permitted Development) (Amendment) (No. 2) (England) Order 2008

This order amends the Town and Country Planning (General Permitted Development) Order 1995 (“GPDO”) to simplify the householder development regime.

 

SI 2008 2093 - The Town and Country Planning (Environmental Impact Assessment) (Amendment) (England) Regulations 2008

These Regulations amend the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1991 so that they apply to applications for subsequent approval of matters under conditions attached to planning permissions.

 

SI 2008 1371 - The Town and Country Planning (Local Development) (England) (Amendment) Regulations 2008

The Regulations amend the Town and Country Planning (Local Development) (England) Regulations 2004 ("the 2004 Regulations") to simplify and deregulate the local development plan making procedures in England.

 

SI 2008 958 - The Town and Country Planning (Fees for Applications and Deemed Applications) (Amendment) (England) Regulations 2008

This instrument makes amendments to the Town and Country Planning (Fees for Applications and Deemed Applications) Regulations 1989 (SI 1989/193) ("the 1989 Regulations"). It increases the level of fees payable to local planning authorities in England for planning applications, deemed planning applications, and applications for consent to display advertisements, made on or after 6 April 2008.

 

SI 2008 675 - The Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2008

This order provides permitted development rights for the installation of specified types of microgeneration equipment including solar PV and solar thermal equipment on or within the curtilage of dwellinghouses subject to certain criteria.

 

SI 2008 550 - The Town and Country Planning (General Development Procedure) (Amendment) (England) Order 2008

This order amends the Town and Country Planning (General Development Procedure) Order 1995, which specifies procedures connected with planning applications, appeals to the Secretary of State, and related matters not laid down in the Town and Country Planning Act 1990. It came into force on 6 April 2008.

 

SI 2007 0783 - The Town and Country Planning (Control of Advertisements) (England) Regulations 2007

These regulations outline the set of procedures relating to the displaying of advertisements in England, and replace the Town and Country Planning (control of Advertisements) Regulations 1992.

 

SI 2006 2375 - The Town and Country Planning (General Development Procedure) (Amendment) (No. 2) (England) Order 2006

This Order, which applies to England only, amends the Town and Country Planning (General Development Procedure) Order 1995. It introduces further requirements to consult the Environment Agency before applications for development in certain areas are determined.

 

SI 2006 1062 - The Town and Country Planning (General Development Procedure) (Amendment) (England) Order 2006

This order amends the Town and Country Planning (General Development Order) 1995. It specifies the procedures connected with planning applications, appeals to the Secretary of State and related matters so far as these are not laid down in the Town and Country Planning Act 1990 ("the 1990 Act") and the Town and Country Planning (Applications) Regulations 1988 (S.I. 1988/1812).

 

SI 2005 2115 - The Town and Country Planning (Major Infrastructure Project Inquiries Procedure) (England) Rules 2005

These rules outline the procedures to be followed for local inquiries into 1) applications for planning permission or 2) the approval of local planning authorities for major developments deemed to have national or regional importance.

 

SI 2005 2087 - The Town and Country Planning (General Development Procedure) (Amendment) (England) Order 2005

This Order amends the Town and Country Planning (General Development Procedure) Order 1995. It sets out a timeframe of 21 days for statutory consultees to provide advice on the applications they are consulted on. However, it is recognised that a 21-day period may not be appropriate for all applications – particularly those more complex applications that require a longer period of time to consider and therefore consultees can agree different periods where appropriate.

 

SI 2005 0206 - Town and Country Planning (Temporary Stop Notice)(England) Regulations 2005

These regulations restrict the use of temporary stop notices (TSNs) in certain circumstances against caravans used as a main residence.

 

SI 2004 2208 - The Town and Country Planning (Regional Planning Guidance as Revision of Regional Spatial Strategy) Order 2004

This Order sets out the schedule and steps taken towards the revision of the
Regional planning guidance (RPG).

 

SI 2004 2207 - The Town and Country Planning (Regions)(National Parks)(England) Order 2004

This Order explains that, in relation to the regional spatial strategy (RSS),  the North York Moors National Park and the Yorkshire Dales National Park are treated as falling within the Yorkshire and Humber Region and that the Peak District National Park is treated as falling within the East Midlands Region.

 

SI 2004 2206 - The Town and Country Planning (Initial Regional Spatial Strategy)(England) Regulations 2004

These Regulations list the regional planning guidance (RPG) for each region that is to become the regional spatial strategy (RSS) for that region.

 

SI 2004 2205 - The Town and Country Planning (Transitional Arrangements) (England) Regulations 2004

Part 2 of the Planning and Compulsory Purchase Act 2004 changes the local development planning system in England. These Regulations cover transitional arrangements that will apply as the changes are brought into effect.

 

SI 2004 2204 - The Town and Country Planning (Local Development) (England) Regulations 2004

Part 2 of the Planning and Compulsory Purchase Act 2004 (PCPA) establishes a new system of local development planning. It applies only to England. Local planning of the development and use of land is presently dealt with local plans, unitary development plans and structure plans. Part 2 provides that these plans will be replaced by local development documents.

 

SI 2004 2203 - The Town and Country Planning (Regional Planning) (England) Regulations 2004

Part 1 of the Planning and Compulsory Purchase Act 2004 (PCPA) establishes a new system of regional development planning. It applies only to England. Regional planning of the development and use of land is presently dealt with by administrative means. Part 1 PCPA and these Regulations place regional planning on a statutory footing.

 

SI 2002 2686 - The Town and Country Planning (Enforcement)(Inquiries Procedure)(England) Rules 2002

These Rules set out the procedures to be followed for local inquiries into:
(a) appeals against enforcement notices, (b) appeals against the refusal or non-determination of an application for a certificate of lawful use or development and (c) appeals against listed building enforcement notices and conservation area
enforcement notices.

 

SI 2002 2685 - The Town and Country Planning (Enforcement) (Determination by Inspectors) (Inquiries Procedure) (England) Rules 2002

These Rules set out the procedures to be followed for local inquiries held by inspectors appointed by the Secretary of State into:
(a) appeals against enforcement notices, (b) appeals against the refusal or non-determination of an application for a certificate of lawful use or development and (c) appeals against listed building enforcement notices and conservation area
enforcement notices.

These Rules regulate the procedures to be followed for hearings in England, caused by the Secretary of State, to be held before appeals against enforcement notices, listed building and conservation area consent enforcement notices.

These Regulations re-enact with amendments the Town and Country Planning (Enforcement Notices and Appeals) Regulations 1991, especially in relation to the contents of enforcement notices, the procedures to be followed in relation to appeals against them, as well as appeals against listed building and conservation areas enforcement notices.

These Regulations lay down the procedures and time limits for appeals against

These Regulations modify parts of the Town and Country Planning Act 1990 as they apply to the winning and working of minerals and involving the depositing of mineral waste.

 

SI 1995 1804 - The Units of Measurement Regulations 1995

These Regulations implement Council Directives that provide for the phasing out of the use of imperial units of measurement.

 

SI 1995 1139 - The Town and Country Planning (Crown Land Applications) Regulations 1995

These Regulations detail changes to the Town and Country Planning Act 1990 and to the Town and Country Planning (General Development Procedure) Order 1995, in their application to Crown land. The modifications relate to applications for planning permission and lawful development certificates.

The main purpose of this Order is to grant planning permission for certain classes of development without any requirement for an application to be made under Part III of the Town and Country Planning Act 1990.

These Rules detail the procedures to be followed in England and Wales in respect of public local inquiries concerned with compulsory purchase orders.

These Rules regulate the procedures to be followed in England and Wales in respect of public local inquiries which are held in connection with schemes and orders proposed to be made by the Secretary of State or made by local highway authorities.

 

SI 1994 2716 - The Conservation (Natural Habitats, &c.) Regulations 1994
